Confused by building industry payment laws?
More changes came into effect on 1 October 2020. If you have any questions, or don’t quite understand the ins & outs of the building industry payment laws, you need to come to one of our workshops.
These changes to the Building Industry Fairness (Security of Payment) Act 2017 (BIFA) include new penalties and new obligations on both the claimant and the respondent. You need to make changes to your business processes to comply - we can help you.
Our four-hour interactive workshops have been designed specifically for builders, subcontractors, manufacturers and suppliers to the construction industry. Find out what you need to know to get it right from the get-go and avoid hefty fines and other penalties.
Learn from a Master Builders Members Legal specialist what you need to do to comply, how to protect your right to payment and what contracts you can use to drastically reduce your paperwork.
CSQ funding for small businesses now available.^
For funding information, see Course Details below or contact us (eligibility applies).
Chapter 3 of the BIFA Act commenced on 17 December 2018 and applies to all projects from $0 and up, residential and commercial projects, civil works and building projects, licensed and unlicensed building work.
It will apply even if you are not in dispute and applies to builders, subcontractors, suppliers, consultants and principals/owners.
There are mandatory obligations with hefty fines and, if you are a QBCC licence holder, disciplinary action as well. It is a complex process that will require you to change the way you run your business to protect yourself.
The session is interactive and will focus on the practical elements of how this chapter of the BIFA Act works on day to day activities and will answer questions such as:
- Which contracts does it apply to?
- What do I need to put in my contract to protect myself – both as a claimant and as a respondent?
- What's required for a payment claim and what does it looks like?
- How do I respond to a payment claim?
- If I have not been paid, what can I do?
